Welcome to ThemeQR. These Terms of Service (“Terms”) govern your access to and use of ThemeQR websites, applications, tools, documentation, and related services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms.
You must be 13+ to use ThemeQR. If you are under 18, you must have permission from a parent or legal guardian and they must accept these Terms on your behalf. ThemeQR is not directed to children under 13.
Sign-in may be provided via third-party authentication (e.g., Google through Supabase OAuth). You are responsible for safeguarding your credentials and activity on your account. You must provide accurate information and keep it up to date. We may refuse, suspend, or terminate accounts that violate these Terms or applicable law.

We may add, modify, or deprecate features (including beta features) from time to time.
You own the content you upload or create (images, text, videos, generated assets, themes, links, and metadata) (“User Content”). To operate the Service, you grant ThemeQR a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, display, perform, and distribute your User Content solely to provide and improve the Service (e.g., rendering themes, generating previews/exports, delivering landings via CDN, content caching, moderation, backups). This license ends when your content is deleted from our systems, subject to reasonable backup/archival retention.
You represent and warrant that you have all rights necessary to upload or create User Content and to grant the license above; that your content and use of the Service do not infringe any third-party rights; and that you will comply with all applicable laws.
You may not use the Service to upload, create, link to, or distribute content that is:
We may remove or disable content we reasonably believe violates these Terms or the law.
Certain features depend on third-party services (e.g., Tenor/Giphy for GIF search, Supabase for auth/data, hosting/CDN/analytics, payment processors such as Stripe, optional AI image providers). Your use of those features is also subject to the third-party’s terms and acceptable use policies. ThemeQR is not responsible for third-party services, their availability, or their content.
If you use optional AI image generation:
Media from Tenor/Giphy or other libraries may be subject to separate licenses and attribution requirements; do not remove or obscure any associated notices or watermarks. For uploaded media, upload only what you have the right to use. If you print or merchandise media, ensure you have proper commercial rights.
Dynamic QR codes route to URLs you configure. You are responsible for ensuring your destinations are safe, accurate, and lawful. Do not use QR codes to facilitate phishing, fraud, malware, or unsafe redirections. We may apply rate limits, safety checks, or block routing we believe is harmful.
ThemeQR may collect event data (e.g., scans, clicks, device/geo approximations) to provide analytics, operate the Service, and prevent abuse. Some analytics may be provided via third-party tools. See our Privacy Policy for details. Where required, you are responsible for providing user-facing notices and obtaining any necessary consents for your campaigns.
ThemeQR may offer Free and Paid plans. Paid plans auto-renew unless canceled prior to the renewal date. We will disclose pricing, included features, and any credit/overage schedule before purchase. Refunds are handled per our posted policy (generally prorated only where required by law). We may change plan features and pricing, with notice for active subscriptions.
The Service, including software, designs, branding, documentation, and data structures, is owned by ThemeQR or its licensors and protected by intellectual property laws. Except for your rights to use the Service under these Terms, no other rights are granted. Do not copy, modify, reverse engineer, or create derivative works of the Service.
You can export certain data (e.g., themes/links/analytics JSON) via provided tools. We maintain reasonable backups for reliability, but you are responsible for keeping your own copies of important assets and exports.
If you believe content on ThemeQR infringes your copyright, send a notice to our designated agent: DMCA Agent — Email: bdkelmon@gmail.com Please include: (a) your contact info; (b) identification of the copyrighted work; (c) the allegedly infringing material and location; (d) a statement of good-faith belief; (e) a statement under penalty of perjury that your notice is accurate and you are authorized; and (f) your signature (electronic is fine). We may notify the user who posted the material and, where appropriate, accept counter-notices consistent with the DMCA.
You may stop using the Service or delete your account at any time. We may suspend or terminate your access if we reasonably believe you violated these Terms, pose a security or legal risk, or if required by law. Upon termination, certain sections survive (e.g., IP, disclaimers, limitation of liability, indemnity, governing law).
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation or that content will be accurate or secure.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEMEQR AND ITS OWNERS, AFFILIATES, AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO THEMEQR IN THE 6 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
You will defend, indemnify, and hold harmless ThemeQR and its owners/affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Service, or your violation of these Terms or the law.
We may update the Service and these Terms from time to time. If we make material changes, we will provide reasonable notice (e.g., in-app notice or email). Your continued use after changes become effective constitutes acceptance.
These Terms are governed by the laws of the State of North Carolina, without regard to conflicts of law. You and ThemeQR agree to the exclusive jurisdiction and venue of the state and federal courts located in Catawba County, North Carolina for any dispute that is not subject to arbitration.
